Applying for Letters of Administration
When someone passes away without a will.
This guide is general information only and is not legal advice.
When is it needed?
When a person dies without a will and leaves assets (for example land, bank accounts, shares or vehicles), someone must be appointed to administer the estate.
The main steps
- Gather information about the deceased’s assets and liabilities.
- Identify the beneficiaries.
- We advise which authority handles the estate (High Court, Estate Distribution Unit or Amanah Raya Berhad).
- Prepare and file the application, including any sureties required.
- Once the grant is issued, the administrator collects the assets, pays debts and distributes the estate.
Checklist
- Death certificate
- MyKad of the deceased and of the beneficiaries
- Marriage and birth certificates showing relationships
- Documents for each asset (title, bank statements, share statements, vehicle grant)
- Details of any debts
